Highlights of Batesville’s curbside pickup amendment

UPDATE, Jan. 10, 2019, 10:30 a.m.: White River Now’s Gary B. spoke with Batesville Mayor Rick Elumbaugh this morning regarding the proposed ordinance to amend the city’s residential curbside waste ordinance and potential violations if the requirements are approved and implemented. “We’re not going to throw anyone under the bus,” Elumbaugh said, noting the city will have a grace period before fines will be levied in order for citizens to get used to the requirements. This was referenced at Tuesday’s Batesville City Council meeting during the engineering report when council members were informed a learning curve is expected for the new ordinance. Because of that, citations won’t be handed out to ordinance violators for a period until city officials and departments overseeing waste pickup feel citizens are familiar with the new process.

At last night’s Batesville City Council meeting, the second reading of a proposed ordinance to amend the city’s residential curbside waste ordinance was held. In the proposed ordinance amendment, curbside waste pickup requirements include the following:

  • The city will initially provide curbside customers with only one city-owned waste container for curbside pickup. Additional containers may be rented from the city at a rate to be determined by resolution of the city council. The city will only pick up curbside waste from city-owned containers.
  • Curbside customers shall be responsible for the cost associated with repairing or replacing damaged or lost garbage containers.
  • All waste must be drained of liquid substance before it is placed in a garbage container.
  • The waste container lids must be completely closed for curbside pickup.
  • For all garbage and waste to be collected, it shall be in disposable containers or trash bags within the city containers when placed at the curbside for collection. Such disposable containers should be secure enough that the garbage and waste contained therein remains contained therein during the collection process.
  • Waste containers may not be placed in the front yard except at the times provided. Garbage containers may be placed at curbside after 12 p.m. (noon) on the day prior to collection for that structure and must be removed from the curbside by 12 p.m. (noon) on the day after pickup

The proposed ordinance notes any person violating the requirements, “…shall upon conviction thereof, be adjudged guilty of a violation and fined a sum of not less than $10 and not to exceed the sum of $100 for each offense. That each day of contained violation constitutes a scepter offense.”

The ordinance amendment will be on the next meeting’s agenda for a third and final reading.
