Man arrested again in Southside after reports of harassing customers outside gas station

A Batesville man has been arrested after authorities say he again refused to leave a Southside gas station location.

According to the incident report, Independence County Deputy Sheriff Carey Thomas was dispatched to the Conoco station and convenience store in Southside last night concerning a criminal trespassing situation. regarding an individual he had encountered at the same location a few days before.

Upon arrival, Thomas said he found Timothy Allen Smith (pictured), 49, sitting on a bench outside the store on Monday.

The deputy recognized Smith from an incident at the property a few days earlier where Smith had to be removed for possible trespassing, the report said. This time, Smith could not give Thomas a reason why he was there again, particularly after the earlier criminal trespass warning.

After Thomas placed Smith in hand restraints, the deputy checked with an employee at the store who said Smith was not to be on the property. Smith, the employee told Thomas, had been harassing customers as they entered the store, the report said.

Smith was placed under arrest for criminal trespass and was transported to the Independence County Detention Facility.
