A 23-year-old man who apparently overheated his pickup truck while spinning “donuts” in the parking lot of the Batesville Burger King ended up behind bars Thursday night on two felony drug counts, according to Independence County Circuit Court documents.
The arrest affidavit for Cody Dillon Buffington, who has Poplar Bluff, Mo., listed as his address in his Independence County Jail booking information, says a Batesville Police officer dispatched to the scene found Buffington standing by the truck, which had its hood raised.
When asked by the officer if he was doing donuts, the court info noted Buffington, eating from a container of French fries, looked at the officer and said, “I don’t know!” The affidavit said Buffington was uncooperative, loud, and argumentative — particularly after a K9 unit arrived on the scene — until he was placed into the back of a patrol vehicle for safety reasons.
After an alert from the K9, the court information said a search of Buffington’s vehicle allegedly yielded 1.2 grams of methamphetamine, a glass smoking pipe with white residue, and a set of digital scales, also with white residue.
Buffington is charged with one felony count of possession of a controlled substance (less than 2 grams), one felony count of possession of drug paraphernalia, and one misdemeanor count of disorderly conduct. He is also being charged as a habitual offender, having been previously convicted of four or more felonies. Being charged as a habitual offender can result in an extended term of imprisonment.
