A Stone County man is accusing a Mountain Home pool business of taking his cash deposit and not following through on their agreement to install a swimming pool at his residence.
Ronald Baker and John N. Dunn and his pool company out of Mountain Home agreed on the installation of a 16-feet wide by 41-feet in length pool manufactured by Thursday Pools at a cost of $50,000, according to the info from Stone County Circuit Court.
The court documents say Dunn requested and received from Baker a cash deposit of $25,000 that was made on Sept. 13 of this year, with Baker receiving a written receipt in return.
Baker said Dunn informed him it would take three weeks from the time he ordered the pool to have it from the manufacturer, and then three weeks installation time for a total of six weeks for completion. Baker then said Dunn called in October and said the lead time for the manufacturer to build the pool was “stretched” from three weeks to six weeks, with Dunn saying the pool had been ordered, according to court documents.
In the court information, Baker says the order for the pool was never placed and the work never began to install the pool until after he canceled his order with Dunn.
Baker is accusing Dunn and his pool company of taking his cash deposit and not following through on their agreement. Dunn has been charged in Stone County Circuit Court with theft of propery, a class B felony.
A bond has been set at $20,000.
